    Foreign companies with a permanent establishment in Colombia or those registered for Colombian tax (NIT) must comply with DIAN's e-invoicing mandate. Non-resident companies without a permanent establishment typically don't need to issue Colombian e-invoices, but their Colombian clients must issue Documentos Soporte for the transactions instead. The NIT registration process requires a legal representative domiciled in Colombia.

    When Must Foreign Companies Issue Colombian E-Invoices?

    With Permanent Establishment

    A foreign company has a permanent establishment (establecimiento permanente) in Colombia if it maintains a fixed place of business, construction project exceeding 183 days, or dependent agents. In this case:
    • Must register for NIT with DIAN
    • Must complete habilitación (testing) for e-invoicing
    • Must issue UBL 2.1 electronic invoices for all Colombian income
    • Subject to same penalties as Colombian companies

    Without Permanent Establishment

    • NOT required to issue Colombian e-invoices
    • Colombian buyer issues Documento Soporte for the purchase
    • May need to register as a "no-domiciliado" for withholding purposes
    • Digital services from abroad may be subject to IVA collection obligations

    How to Register for NIT as a Foreign Company

    Appoint a legal representative: Must be domiciled in Colombia with a Colombian cédula Register with DIAN: Submit RUT (Registro Único Tributario) application at dian. gov.
